  1. GENERAL PROVISIONS

 

11. This Regulation was developed on the basis of the Law of the Republic of Kazakhstan "On Education", "On Science", "On the Commercialization of Scientific and / or Scientific Results", "On Copyright and Related Rights", "On Amendments and Additions to Certain Legislative acts of the Republic of Kazakhstan on legal regulation of the intellectual property sphere ", the Charter of the Republican State Enterprise on the right of economic management" Kazakh National University named after al-Farabi "of the Ministry of Education and Science of the Republic of Kaz the Resolution of the Rectorate of the Kazakh National University named after al-Farabi dated September 5, 2016, paragraph 4, October 17, 2016, paragraph 3. and defines the main goals, objectives, objectives and principles of the research (educational / consulting) center of the Kazakh National University named after al-Farabi, as well as the order of the relationship of employees in the implementation of scientific and educational, research, translation and consulting work.
1.2. The research (educational / consulting) center (hereinafter referred to as the Center) is a structural subdivision of the al-Farabi Kazakh National University (hereinafter - the University), functioning on the basis of self-financing.
1.3. Name of the Center:
in the state language - "Computer literate";in Russian - "Computer Science";
in English - "Computer Science";
Shortly - Computer Science.
1.4. The Center "Computer Science" is created on the basis of the order of the rector, the decision of the Academic Council of the University, as a structural unit at the Department of Informatics, the Faculty of Mathematics and Mechanics of the University, which carries out entrepreneurial activities on the basis of economic contracts, without the formation of a legal entity.
1.5. The center is located in the educational building of the Faculty of Mechanics and Mathematics.
1.6. The change in the name of the Center is introduced by the decision of the Academic Council of the University on the orders of the rector of the university.
1.7. The relations arising at the conclusion, execution, change and cancellation of economic contracts are regulated by the Civil Code of the Republic of Kazakhstan, this Regulation and other legislative acts.
1.8. The Center acts on the basis of this Statute, the Charter and other normative documents of the university, it is guided by the legislation of the Republic of Kazakhstan, the Resolutions of the Government of the Republic of Kazakhstan, decisions and instructive letters of higher authorities, university policy in the field of quality.
1.9. The Center is responsible for the required quality of research conducted and coordinated by it and obtaining scientific results for their subsequent commercialization on an economic basis.
1.10. The activities of the Center are supervised in the following areas: general direction - the first vice-rector (advanced training, retraining of staff, translation services); scientific research - pro-rector on scientific and innovative activity (scientific research, expertise and expert services); educational and educational - vice-rector for academic work (educational, consulting and consulting services);
 
social-educational - pro-rector for social development; financial activity - pro-rector on economic and production issues (approval of the list of services provided, monitoring of the financial side of the Center's activities and its financial reporting).
 
2. SUBJECT, PURPOSE, MAIN OBJECTIVES
2.1. The opening of the Center is conditioned by the need for the departments to implement the accumulated scientific, educational, research potential and increase the effectiveness and practical significance of their activities, as well as the gradual transformation of the university into research.
2.2. The objectives of the Center are:
- the organization of improvement of professional skill, retraining of staff of the teaching staff and students of the department / faculty, through the conclusion of economic contracts with legal and physical persons;
- organization and coordination of research work of the teaching staff in cooperation with business structures, industrial and other enterprises;
- Approbation of the results of R & D and ensuring a gradual transition of the country to a knowledge-based economy.
The subject of the Center's activity is professional development, retraining of personnel, conducting research / scientific and educational works, consulting and other types of services in the following main areas:
- Information and communication technologies;
- Information Technology;
- Programming;
- Web technologies.
2.3. To achieve the target, the following tasks must be solved:
- Development of training programs for advanced training courses;
- Forming training groups and scheduling classes;
- Development of computer programs for solving applied problems;
- Issuance of the certificate of the Center.

3. ORGANIZATIONAL STRUCTURE AND MANAGEMENT

 3.1. The Center is headed by the Director appointed by the order of the rector of the University on the basis, within the limits and in the order established by the current university statute. The main functions of the director are:
- search and conclusion of contracts with potential services-recipients;
- ensuring the fulfillment of the obligations taken by the Center before the university;
- Preparation of reporting documentation on the results of the Center's activities.
3.2. The faculty, scientists, students, undergraduates and doctoral students with the involvement of specialists and students from other research institutes, educational institutions, interdepartmental laboratories and campaigns on contractual terms within the framework of relevant concluded economic contracts may be involved in the Center's work.
3.3. The contract on the part of the contractor for the provision of services, according to the approved list of services provided by the Center, is signed by the First Vice-Rector of the University, with the exception of contracts on scientific direction (scientific research, expertise and expert services) signed by the pro-rector for scientific and innovative activities. In this case, the work schedule and cost estimates must be attached to the contract.
 
4. ECONOMIC BASIS OF ACTIVITY
4.1. The centers of the University carry out their activities on the basis of self-financing. Financial resources of the Center are formed from funds received from economic contracts and services provided on a paid basis in accordance with the approved list of services provided, grant funds of international funds and organizations, sponsorship of individuals and legal entities, etc.
4.2. The Center's money is transferred to the University Account with a mandatory indication of the purpose of the payment / transfer center "Computer Science".
4.3. The distribution of funds received by the University is made by the Director of the Center in accordance with the estimate, and in strict accordance with the approved list of paid services provided by the Center.
4.4. When compiling an estimate of expenses, the director of the Center should be guided by the tax legislation, the current regulatory acts of the Republic of Kazakhstan, and make the appropriate social, pension and income deductions.
4.5. The material values ​​purchased by the Center and transferred to the self-supporting Center are on the balance of the university in the subordination of the director of the Center.
4.6. To solve the tasks of the Center, the auditor fund, the material, technical and laboratory base of the university's structural divisions are used, as well as, if necessary, on the basis of agreements of other scientific centers, research institutes, collective laboratories, and third-party organizations.
4.7. From the funds received to the University account, 15% of the amount goes to pay off the overhead and other expenses of the university, and the remaining 85% of the amount remains at the disposal of the Center (includes all tax liabilities provided by the laws of the Republic of Kazakhstan, including 11% social tax and 12% VAT ).
4.8. To monitor the economic and financial activities of the Center, if necessary, an audit commission is appointed by an order of the curating pro-rector or vice-rector for economic and production matters.
4.9. Acts of work performed under the agreement are signed by the director of the Center and one act is drawn up for one type of work.
4.10. The right to sign the director of the Center on the Acts of work performed under the agreement is given on the basis of the Rector's order for the university.
4.11. The remuneration of labor involved in the provision of professional services is made on the basis of applications submitted by the Director of the Center. The application is made for each contract completed by the act of the executed works or by the 20th day of each month - the general application for the monthly work result is made in the name of the pro-rector, whose signature was entered into the contract.
 


5. PLANNING
5.1. The Center independently determines the main directions of scientific-educational / scientific-consulting and other activities that do not contradict the University Charter and in accordance with the priority areas of scientific and technological development of the Republic of Kazakhstan, the development strategy of the KazNU. al-Farabi and the scientific direction of the department.
5.2. The basis of the research plans of the Center (research direction) is thematic plans, research projects, draft contracts with customers, market research of the market of scientific, educational, consulting and other products and assessing consumer demand.
6. ACCOUNTING AND REPORTING
6.1. The Director of the Center (the Research Direction) annually provides a calendar work plan for the Center for the current academic year to the Department for Science and Innovation Activity until September 10.
6.2. The list of services provided by the Center and their cost is coordinated with the Department of Economics and Finance of KazNU. al-Farabi and is approved by the pro-rector on economic and industrial issues.
6.3. The Center provides a report on the results of its activities to the Process Management Sector of the Center for Strategic Development, as well as to the Departments for the areas of activity upon their request.
6.4. Comprehensive and targeted inspections of the self-supporting Center are carried out by the relevant departments of the university.
7. PAYMENT OF WORK OF EMPLOYEES
7.1. The procedure and the system of remuneration of labor, the amount of funds allocated to pay employees, are determined by the director of the Center in the manner prescribed by law, within 85% of the total contractual amount (includes 11% social tax, 12% VAT, 10% individual pension tax, .
7.2. The transfer of funds is made on the basis of applications submitted by the Director of the Center for the payment of attracted specialists. The application is provided for each act of completed (completed) works under the contract.
 
8. RIGHTS AND OBLIGATIONS OF EMPLOYEES
8.1. Employees of the Center are responsible for the proper observance of their duties in accordance with the current legislation of the Republic of Kazakhstan, for compliance with the Code of Corporate Culture of the teacher and employee of the KazNU. al-Farabi, for the proper organization and efficiency of the Center's activities, for the safety of property and information security.
8.2. The employees of the Center have the right:
To implement professional service activities, the Center's employee has the right to:
- ensuring the proper organizational and technical conditions necessary for the performance of official duties. To use the auditor fund and laboratory facilities, facilities and equipment of the University's material and technical base (audio and video equipment, multimedia equipment, library funds, etc.), Internet resources;
- familiarization with the official regulations and other documents that determine his rights and responsibilities for the position held, the criteria for assessing the effectiveness of the performance of official duties, performance indicators of professional performance and the conditions of official growth;
- rest provided by the establishment of a normal length of office hours, the provision of days off and non-working holidays, as well as annual paid basic and additional holidays;
- remuneration of labor and other payments in accordance with the Decree of the Government of the Republic of Kazakhstan, other regulatory legal acts of the Republic of Kazakhstan and with the employment contract;
- Obtaining, in accordance with the established procedure, information and materials necessary for the performance of official duties, as well as making suggestions for improving the activities of the Center and other units of the university;
- to protect copyrights to the products received (results) of research activities. On personal intellectual property received outside of the connection with the performance of professional duties;
- publication of scientific results of their professional service, which is not a state secret in scientific, scientific and technical and other publications;
- access in accordance with the established procedure to information constituting a state secret, if the performance of official duties is related to the use of such information;
- access in accordance with the established procedure in connection with the performance of official duties in state bodies, public associations and other organizations;
- consideration of individual service disputes in accordance with the employment contract and other laws;
- carrying out an official check of the Center upon his application;
- protection of their rights and legitimate interests in the performance of professional service, including appealing to the court of their violation;
- medical care for themselves and their family members in the medical center of the university during the procedure of attachment;
- mandatory state pension contributions in accordance with the law of the Republic of Kazakhstan.
8.3. The employee of the Center is obliged:
- perform official duties in accordance with the official regulations;
- observe the internal routine of the scientific institution at the place of work.
- publish scientific results of their professional performance in scientific, scientific and technical and other publications;
- to raise and maintain the level of qualifications necessary for proper performance of official duties.
- not to disclose information constituting a state secret, as well as information that became known to him in connection with the performance of his official duties.
- to treat carefully and preserve the property of the university entrusted to them, including that granted to him for the performance of his official duties and to compensate for the material loss in accordance with the established procedure.
- take part in the popularization of scientific branches of knowledge related to his professional activities and use the university logo in all presentation materials;
- provide the necessary information related to the performance of professional duties;
- provide the results of the Center's activities to hear at the meetings of the Academic Council of the university, faculty and departments as necessary;
- to fight against plagiarism, pseudoscience and its manifestations.
Requirements for the professional conduct of a scientific employee.
The scientific employee is obliged:
- to perform official duties in good faith, at a high professional level;
- not to commit actions related to the influence of any personal, property (financial) and other interests that interfere with conscientious performance of official duties;
- Do not commit acts that discredit his honor and dignity;
- not to allow conflict situations that could damage his reputation or the image of the university;
- to observe the established rules of public statements and the provision of scientific information for publication in scientific publications;
- Research officer, who holds the position of "leader", is obliged not to allow cases of coercion of employees to unreasonably include themselves in the co-authors of scientific works.
9. LIQUIDATION
9.1. The liquidation of the Center is carried out by the order of the rector of the University on the basis of the decision of the Academic Council of the University.
9.2. This provision is put into effect from the moment of its approval by the First Vice-Rector of the University.
